An agent can compare, select and pay. At D31, we propose that delegation preserve the consumer’s ability to understand, contest and regain control of the transaction. The scope of applicable rights depends on the jurisdiction and the case.

Reuters reported banking proposals on transparency, privacy and consumer choice in agentic commerce. These are sector proposals, not a global rule.
The Ninth Circuit opinion in Amazon.com Services, LLC v. Perplexity AI, Inc. examined an agentic browser operating locally under user direction. Its narrow reading of “access” under CFAA/CDAFA helps separate user, tool and server, but does not decide contract, tort, consumer protection or platform rules by itself.

A purchasing mandate should carry a chain of rights:
- disclosure that an agent is involved;
- purpose and spending limits;
- data sources and conflicts of interest;
- provider and payment-method choice;
- confirmation proportional to risk;
- an understandable decision record;
- dispute, cancellation, restitution and revocation;
- attribution across user, agent provider, merchant and platform.
The human 51% does not require confirming every click. It requires a real ability to define criteria, understand consequences and recover control.
Hypothesis under test
Agentic commerce will expand autonomy only if the speed of delegation grows alongside the capacity to contest, reverse and restore.
Limits
